MOONCHALK – PRIVACY POLICY

This Privacy Policy describes how Moonchalk LLC (“Moonchalk,” “we,” “us,” or “our”) collects, uses, and shares your personal information when you visit, interact with, or make a purchase from moonchalk.com (the “Site”) or subscribe to any of our products or services.

1. Personal Information We Collect

Device Information

When you visit the Site, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you browse the Site, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site. We refer to this automatically collected information as “Device Information.”

We collect Device Information using the following technologies:

  • “Cookies” are data files that are placed on your device or computer and often include an anonymous unique identifier. For more information about cookies, and how to disable cookies, visit http://www.allaboutcookies.org.
  • “Log files” track actions occurring on the Site, and collect data including your IP address, browser type, Internet service provider, referring/exit pages, and date/time stamps.
  • “Web beacons,” “tags,” and “pixels” are electronic files used to record information about how you browse the Site, including pixels and tags from advertising and analytics platforms such as Meta (Facebook) and Google.
Order Information

Additionally, when you make a purchase or attempt to make a purchase through the Site, we collect certain information from you, including your name, billing address, shipping address, payment information (including credit card numbers, processed by our payment processors and never stored on our servers in full), email address, and phone number. We refer to this information as “Order Information.”

Subscription Information

If you sign up for the Moonchalk Monthly subscription (or any other recurring subscription we offer), we also collect and retain billing details necessary to process recurring charges, your subscription status, renewal date, shipping preferences for recurring deliveries, and your subscription history. Your full payment card details are stored securely by our PCI-compliant payment processor (Checkout Champ Payments and/or Stripe), not directly by Moonchalk. You may cancel your subscription at any time from your account page or by contacting us at contact@moonchalk.com.

When we talk about “Personal Information” in this Privacy Policy, we are referring to Device Information, Order Information, and Subscription Information collectively.

2. How We Use Your Personal Information

We use the Order Information and Subscription Information that we collect generally to fulfill any orders placed through the Site (including processing your payment information, processing recurring subscription charges, arranging for shipping, and providing you with invoices and/or order confirmations). Additionally, we may use Personal Information for purposes including, but not limited to:

  • Communicating with you about your orders, your subscription, and your account.
  • Screening orders for potential risk or fraud.
  • When in line with the preferences you have shared with us, providing you with information or advertising relating to our products, services, and promotions.
  • Improving the effectiveness of our Site, marketing endeavors, and service offerings.
  • Providing customer service and responding to your inquiries.
  • Notifying you of product recalls or providing other information concerning products you have purchased.
  • Sending you direct mail and email communications such as newsletters, drop announcements, or promotions you have opted in to receive.
  • Sending you transactional email about orders you have made, subscription renewals, shipping updates, and account activity.
  • Identifying your product and service preferences and informing you of new or additional products, services, and promotions that may be of interest to you.
  • Analyzing preferences, trends, and statistics to improve our offering.

We use the Device Information that we collect to help us screen for potential risk and fraud (in particular, your IP address), and more generally to improve and optimize our Site (for example, by generating analytics about how our customers browse and interact with the Site, and to assess the success of our marketing and advertising campaigns).

Cart Abandonment

When you enter your contact information into a form on the Site (for example, the first step of a checkout or opt-in form), you are tagged as a lead in our system. If you do not complete a purchase within a defined time window, you may receive one or more abandonment reminder emails letting you know your selection is still available, with a direct link back to checkout. You can unsubscribe from these messages at any time using the link included in every email. We do not currently send abandonment messages by SMS.

3. Sharing Your Personal Information

We share your Personal Information with third parties to help us use your Personal Information, as described above. For example:

  • We use Checkout Champ to power our online store.
  • We use email service providers and customer-relationship platforms to send transactional and marketing emails.
  • We may use payment processors such as Checkout Champ Payments and Stripe to process payments and recurring subscription charges.
  • We may share Personal Information with shipping carriers and fulfillment partners in order to deliver your orders.
  • We may share Personal Information with advertising platforms such as Meta (Facebook) and Google to measure and optimize advertising campaigns and to show you relevant ads.

Finally, we may also share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant, or other lawful request for information we receive, or to otherwise protect our rights.

4. Behavioral Advertising

As described above, we use your Personal Information to provide you with targeted advertisements or marketing communications we believe may be of interest to you. 5. Do Not Track

Please note that we do not alter our Site’s data collection and use practices when we see a Do Not Track signal from your browser.

6. Your Rights

California Residents (CCPA / CPRA)

If you are a California resident, the California Consumer Privacy Act (“CCPA”), as amended by the California Privacy Rights Act (“CPRA”), provides you with specific rights regarding your Personal Information, including:

  • Right to Know: You have the right to request that we disclose the categories and specific pieces of Personal Information we have collected about you, the categories of sources from which we collected it, the business or commercial purpose for collecting or sharing it, and the categories of third parties with whom we share it.
  • Right to Delete: You have the right to request that we delete the Personal Information we have collected from you, subject to certain exceptions.
  • Right to Correct: You have the right to request that we correct inaccurate Personal Information that we maintain about you.
  • Right to Opt Out of Sale or Sharing: You have the right to opt out of the “sale” or “sharing” of your Personal Information for cross-context behavioral advertising. To exercise this right, you may use any “Do Not Sell or Share My Personal Information” link on our Site, configure your browser’s Global Privacy Control (GPC) signal, or contact us at contact@moonchalk.com.
  • Right to Limit Use of Sensitive Personal Information: To the extent we process sensitive Personal Information beyond what is necessary to provide our services, you have the right to limit such use.
  • Right to Non-Discrimination: We will not discriminate against you for exercising any of your CCPA/CPRA rights.

To submit a request, please email us at contact@moonchalk.com with the subject line “California Privacy Request.” We will verify your identity before fulfilling your request and will respond within the timeframes required by applicable law. You may also designate an authorized agent to make a request on your behalf, subject to verification.

Other U.S. State Privacy Rights

Depending on your state of residence (including, where applicable, Virginia, Colorado, Connecticut, Utah, Texas, Oregon, and other states with comprehensive consumer privacy laws), you may have similar rights, including the right to access, correct, delete, or obtain a portable copy of your Personal Information, and to opt out of targeted advertising, the sale of Personal Information, and certain profiling activities. European Residents

If you are a European resident, you have the right to access personal information we hold about you and to ask that your personal information be corrected, updated, or deleted. If you would like to exercise this right, please contact us using the contact information below.

Additionally, if you are a European resident we note that we are processing your information in order to fulfill contracts we might have with you (for example, if you make an order through the Site), or otherwise to pursue our legitimate business interests listed above. Please also note that your information will be transferred outside of Europe, including to the United States.

7. Data Retention

When you place an order through the Site, we will maintain your Order Information for our records unless and until you ask us to delete this information, or as otherwise required by applicable law (including tax, accounting, and fraud-prevention obligations). Subscription Information is retained for as long as your subscription is active and for a reasonable period thereafter to handle returns, disputes, and legal obligations.

8. Security

We take reasonable administrative, technical, and physical safeguards to protect Personal Information from unauthorized access, disclosure, alteration, or destruction. However, no method of transmission over the Internet or method of electronic storage is 100% secure, and we cannot guarantee absolute security.

9. Minors

The Site is not intended for individuals under the age of 18. We do not knowingly collect Personal Information from children under 13 in compliance with the Children’s Online Privacy Protection Act (“COPPA”). If you believe a child under 13 has provided us with Personal Information, please contact us at contact@moonchalk.com so we can take appropriate action.

10. Changes to This Privacy Policy

We may update this Privacy Policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal, or regulatory reasons. The “Last updated” date at the top of this policy indicates when it was most recently revised. Material changes will be communicated through the Site or by other means where appropriate.
